General Terms and Conditions

General terms and conditions for the race organized by Göteborgs Friidrottsförbund (Gothenburg Track and Field Association)

  1. GENERAL

These general terms and conditions (“General Terms and Conditions”) apply to races organized by Göteborgs Friidrottsförbund (Gothenburg Track and Field Association). When we mention “we”, “our”, and “us” then we are referring to Göteborgs Friidrottsförbund, org nr. 857202-2799, Box 12174, 402 42 Gothenburg, that organizes, among other races, the Göteborgsvarvet Half Marathon and Göteborgsvarvet Marathon 2021.

By registering (done either yourself or by another) for one of the races that we organize, you are accepting our General Terms and Conditions for registered participants in the race.

A valid registration to the race occurs after you have registered and after we have received the registration fee, whereby a binding contract is made between us. When you sign up for a race by entering a so-called promotional code (“Promotional Code”) or via a so-called group registration (“Group Registration”) it is only after you have registered and we have received adequate payment for Promotional Code/Group Registration that a binding contract forms between us.

Please note that if you have signed up by using a promotional code or signed up through a group registration then certain terms and conditions apply for you. Note certain exceptions in paragraph 7 regarding the transfer of start number.

We reserve the right to assign our rights and obligations according to these Terms and Conditions to another.

To register for a race you must be at least 18 years of age. If you are under 18 you must have a legal guardian’s approval to be a part of the contract. In the case that you register someone else other than yourself to a race, you are accepting full responsibility for and ensure that the person is aware of and accepts the terms and conditions the same as you.

Your start number is personalized and you may not let someone else run the race in your name/in your place.

You are responsible for your password and username to your page on our website www.goteborgsvarvet.se and should not be given to someone else or get in the wrong hands.

It is forbidden to participate in the race with wheels or other devices like wheelchairs, hand bikes, bikes, inline skates, strollers, and walking poles unless stated otherwise.

Please note there is a time limit for each respective race. We reserve the right to stop or end the race before you have finished the race with reference to this time limit.

We reserve the right to change these Terms and Conditions. We have the right to unilaterally amend these General Terms and Conditions. Any changes shall enter into force no earlier than 30 days after the amended Terms and Conditions have been made available on the website. If we were to make significant changes to these Terms and Conditions, you are entitled to terminate the contract you signed with us.

  1. BOOKING, PRICES AND PAYMENT

 Information about the race, prices and methods of payment are all present on the website when you sign up. Before submitting your registration we ask you to carefully review and verify that the information shown in your registration is accurate.

When registering for a race, you are required to give your name, personal identity number, address, telephone number and email. By sending the registration you are certifying that the information that you provide about yourself and any other participants are true and correct.

All the prices stated on the website include VAT. Our prices and fees can change from circumstances that are beyond our control. We, therefore, reserve the right to adjust our prices and fees. We reserve the right for printing and typing errors, full bookings, as well as, any other unexpected occurrence that might occur.

We provide a paying service through PayEx where you can complete your payment via credit card or direct payment. The information you provide, for example, your card number, personal identification number and the amount is sent to PayEx. PayEx does not have permission to forward this information to third parties except to the card companies or banks for the authorization of the amount that will be withdrawn from the account. PayEx uses the latest in security technology and works closely with the banks and finance inspection to ensure quality and security.

In order to process your reservation when you pay with credit card you must enter your card number and the card’s expiration date (year and month).

If you have signed up for a race by registering a Promotional Code or if registered via a Group Registration then the above terms and conditions regarding payment do not apply to you. Your payment is made either by the person who provided you with the Promotional Code or the one who entered the Group Registration.

Please note that your account will be debited at the time of the purchase.

Fraud and false orders are reported to the police.

 

  1. BOOKING CONFIRMATION

 After you have paid the full amount of the registration you will receive a booking confirmation sent to you on the email address you provided. This applies even if you are paying with a Promotional Code.

If you have not received your booking confirmation within a week after your payment, please contact us at the above email address or telephone number.

  1. OUR RESPONSIBILITY

 We assume no liability for injuries resulting from the violation of these Terms and Conditions.

By accepting these Terms and Conditions you are accepting that you participate in the race at your own risk and that we are not liable for injury or injuries that may be incurred by participation of the race.

  1. OUR OBLIGATIONS

 We reserve the right to cancel one or more races or change the race’s route or start time;

a) due to circumstances beyond our control, including but not limited to government action or omission, new or amended legislation, industrial disputes, blockades, fire, flood or emergency/ accident(s) on a large scale,

b) if we or the authorities deem this to be necessary for your or other participants’ safety or health, or

c) if the race is not sanctioned by Svenska Friidrottsförbundet (The Swedish Track and Field Association), or if we are not granted the regulatory approvals required for us to have or be able to implement the race.

We have no obligation to refund the registration fee or to pay damages or other compensation in the event that one or more races must be cancelled or in the event of changes according to paragraphs a) – c) above.

If you register to run the Göteborgsvarvet Half Marathon for charity, the highest start group that you will be placed in is start group 12.

  1. CANCELLATION AND CHANGES TO YOUR REGISTRATION

 Your registration for the race is binding, and the paid registration fee is non-refundable.

In the event of illness or injury, you may receive compensation from your insurance company if you are insured under the Folksam Insurance “Startklar” or an equivalent insurance with another insurance company at the time of registration.

  1. TRANSFER OF START NUMBER

You are able to transfer your start number to someone else if registered to Göteborgsvarvet Half Marathon 2017 or Göteborgsvarvet Marathon 2021 for a fee of two hundred and fifty (250) SEK. You can transfer your registration for the Göteborgsvarvet Half Marathon until April 30th 2017 and until August 31, 2021 for the Göteborgsvarvet Marathon 2021. You may transfer your start number by registering it on our website. You are not allowed to give your start number to another person or allow another person to run in your place, without paying the fee and registering the transfer on our website.

 Please note that the buyer does not take over the seller’s place in the start wave (starting group) in connection with the transfer of the start number. If you buy a start number March 24, 2017 at the latest (Göteborgsvarvet Half Marathon) and June 30, 2021 at the latest (Göteborgsvarvet Marathon 2021) you are placed into the start wave (start group) according to the original seeding rules. If you buy a start number between March 25 – April 30, 2017 (Göteborgsvarvet Half Marathon) and between July 1 – August 31, 2021 (Göteborgsvarvet Marathon 2021) then you are placed in the start wave (start group) according to the original seeding rules, subject to availability, otherwise the next group, where there is a place available. Transferring of a start number can only be done for Göteborgsvarvet Half Marathon and Göteborgsvarvet Marathon 2021.

Please note that you are not allowed to transfer your start number to someone else if you have signed-up by using a Promotional Code or through a Group Registration, then other terms and conditions apply for transferring your start number to another person. If you wish to transfer your start number you should contact your employer or another responsible party for further instructions.

  1. PERSONAL DATA PROCESSING

We will process your personal information when you register for the race. We take full responsibility that all processing of your personal information is done in accordance with the Personal Data Act (1998: 204).

Our main purpose when processing your personal data is to be able to handle your booking, administer your account and in general fulfill our commitments to our customers. We also store your personal information in order for you to obtain relevant information from us or from our partners. Our partners will be processing and handling your personal information in the same way as us when it comes to sending you information and offers.

The personal data that we will primarily be dealing with is the information that you directly or indirectly provide to us when registering for the race, such as first and last name, mailing address, personal identity number, email address, mobile number, race results, photos and TV broadcasting may occur.

By accepting these General Terms and Conditions you are agreeing to our processing of your personal data that are described in these Terms and Conditions.

You have the right, once a year, free of charge, to obtain information about which personal data we have registered about you and how it is used. The request must be written to us on our address give above.

You are also always entitled to request in writing that we will correct or remove inaccurate personal data and to revoke your previously provided consent.

  1. MARKETING

 We may store and process your personal data as described above for marketing purposes for up to three years after our customer relationship has been discontinued.

We, including our corporate partners, have the right to contact those who have registered for the race regarding information or offers. If you enter your mobile phone number or email address you are agreeing that we, including our partners, may send you information or offers to your telephone number, email or address.

We will be publishing personal information about you such as name, race results, photos, and TV broadcastings that you may appear in both on the internet and in the newspapers as news and advertising material which you will not be able to receive or demand compensation for.

  1. REPORTING A COMPLAINT

If you have any complaints we ask you to contact us on the email address indicated above.

As a consumer you have the right to complain about a faulty service within three years of the service performed. Please note that you must notify us of the error “within reasonable time” after you discovered the error. You may do so by ordinary mail: Göteborgs Friidrottsförbund, org nr. 857202-2799, Box 12174, 402 42 Göteborg, or the email address or telephone number indicated earlier. If you put in your complaint with 2 months from the date that you discovered the error then we consider this a reasonable time.

  1. DISPUTES

We always strive for our customers to be satisfied with our services. If you are not satisfied please contact us and we will do our best to solve the problem. If you are still not satisfied you may contact Allmänna reklamationsnämnden (The National Board for Consumer Disputes), Box 174, 101 23 Stockholm, or to the EU Commission online platform for dispute settlements: http://ec.europa.eu/odr.  We do not commit to the participation of alternative dispute settlements but will take a final stand on this matter when and if a dispute occurs.
